These Terms and Conditions (“Terms”) govern your use of ajhomerentals.com, book.ajhomerentals.com, and the reservation and accommodation services offered by A & J Home Concierge, LLC, doing business as AJ Home Rentals (“AJ Home Rentals,” “we,” “us,” or “our”).

By accessing our websites, submitting a reservation request, making a payment, signing a rental agreement, or occupying a property managed by AJ Home Rentals, you agree to these Terms.

1. About AJ Home Rentals

AJ Home Rentals provides reservation and property-management services for independently owned vacation, seasonal, monthly, and long-term rental properties in and around The Villages, Florida.

Unless expressly stated otherwise, AJ Home Rentals acts as the authorized property manager or booking agent for the property owner. The property owner remains the owner of the accommodation.

2. Additional Agreements

A reservation may also be governed by:

The applicable property listing

The house and listing rules

A vacation-rental agreement or lease

Payment terms shown during checkout

Community, homeowners’ association, or The Villages rules

Golf-cart or other supplemental agreements

Written addenda accepted by the guest

Together, these documents form the agreement governing the reservation.

If a reservation-specific agreement conflicts with these general Terms, the reservation-specific agreement controls regarding that reservation.

Long-term tenancies may be governed by a separate residential lease and applicable landlord-tenant law.

3. Eligibility to Make a Reservation

The person making the reservation must:

Be at least [INSERT MINIMUM BOOKING AGE] years old

Have legal authority to enter into the agreement

Provide accurate and complete information

Be an occupant of the property unless AJ Home Rentals approves otherwise in writing

Accept financial responsibility for the reservation and for the conduct of all occupants and visitors

AJ Home Rentals may require government-issued identification and other reasonable verification before confirming a reservation or allowing access to a property.

4. Reservation Confirmation

Submitting a reservation request does not guarantee that the property is available or that the request has been accepted.

A reservation becomes confirmed only after:

AJ Home Rentals issues written confirmation;

Required payments have been successfully processed;

Any required rental agreement has been completed; and

Any requested identification or verification has been provided.

AJ Home Rentals may decline or cancel a reservation when reasonably necessary because of:

Inaccurate or incomplete information

Failed or reversed payment

Suspected fraud

Failure to complete required documentation

Violation of occupancy requirements

Property unavailability

Violation of these Terms or the applicable reservation rules

If AJ Home Rentals declines or cancels a reservation before occupancy for reasons unrelated to guest misconduct or breach, amounts paid will be handled according to the applicable reservation agreement and house and listing rules.

5. Rates, Fees, and Taxes

The guest is responsible for the total price disclosed during the booking process, which may include:

Rent

Cleaning charges

Booking or administrative charges

Required damage-protection charges or deposits

Pet charges

Community or amenity charges

Applicable sales, tourist-development, lodging, or other taxes

Optional services selected by the guest

Mandatory charges will be disclosed during the booking process as required by applicable law. Optional charges and government-imposed taxes may be shown separately where permitted.

A quotation is subject to availability and may change before the reservation is confirmed. Once confirmed, the price will be governed by the reservation agreement, except for authorized modifications, added services, additional occupants, unauthorized pets, extensions, damages, fines, or other charges permitted under the agreement.

6. Payment Terms

Payment amounts and due dates will be displayed during checkout or stated in the reservation agreement.

By providing a payment method, the guest authorizes AJ Home Rentals and its payment processors to charge:

Amounts due for the reservation

Approved reservation modifications

Charges authorized under the rental agreement

Damage, excessive-cleaning, missing-item, rule-violation, or other post-stay charges supported by reasonable documentation and permitted by law

If a scheduled payment fails, AJ Home Rentals may request another payment method or cancel the reservation according to the applicable agreement.

A chargeback submitted without first attempting to resolve a legitimate billing concern with AJ Home Rentals does not eliminate the guest’s contractual payment obligations.

7. Security Deposits and Damage Protection

A reservation may require a refundable security deposit, a nonrefundable damage-protection charge, or both. The applicable requirement will be disclosed before confirmation or in the rental agreement.

Guests are responsible for damage, loss, excessive cleaning, unauthorized pets or occupants, fines, and other costs caused by the guest or anyone permitted onto the property by the guest, excluding ordinary wear and tear.

Guests must report property damage promptly.

AJ Home Rentals may charge documented amounts permitted under the rental agreement and applicable law.

Damage-protection products, if offered, may contain exclusions and coverage limits and are not a substitute for responsible conduct.

8. Cancellations and Refunds

Cancellation and refund terms vary by property and reservation. The policy provided in the applicable property listing, house rules, reservation confirmation, and rental agreement governs your reservation.

Guests are responsible for reviewing the applicable cancellation policy before completing a reservation. By confirming a reservation, the guest acknowledges and accepts that policy.

A cancellation is effective only after AJ Home Rentals receives the request and confirms the cancellation in writing.

Refunds, credits, date changes, and any nonrefundable charges will be determined according to the cancellation policy applicable to the reservation. No separate cancellation-policy link is incorporated into these Terms.

Guests are encouraged to purchase appropriate travel insurance for illness, emergencies, weather events, travel disruptions, and other unexpected circumstances.

Nothing in this section limits any non-waivable rights provided by applicable law.

9. Reservation Changes

Requests to change dates, properties, occupants, or other reservation details are subject to availability and written approval.

A modification may change the rental rate, taxes, cleaning charge, or other fees.

A reservation is not modified until AJ Home Rentals confirms the change in writing and any additional amount due has been paid.

10. Check-In and Check-Out

Check-in and check-out times are stated in the applicable property listing, reservation confirmation, rental agreement, or arrival instructions.

Early arrival and late departure require advance written approval and may involve an additional charge.

Guests must follow all arrival, access, parking, and departure instructions.

Unauthorized early arrival or late departure may result in additional charges, including costs caused by disruption to cleaning, maintenance, inspections, or the next reservation.

11. Occupancy and Visitors

Occupancy may not exceed the maximum shown in the property listing, house rules, reservation confirmation, or rental agreement.

Only registered occupants may stay overnight.

Events, parties, commercial activities, and gatherings beyond the approved occupancy are prohibited unless AJ Home Rentals provides advance written permission.

The primary guest is responsible for the behavior of all occupants, visitors, invitees, and service providers the guest permits onto the property.

12. Property Use and House Rules

Guests must:

Use the property only for lawful residential accommodation

Maintain the property in reasonably clean condition

Follow all house and listing rules

Follow applicable community and homeowners’ association requirements

Observe parking, trash, noise, and occupancy restrictions

Avoid conduct that disturbs neighbors

Secure doors, windows, and access devices

Notify AJ Home Rentals promptly of damage, hazards, leaks, or maintenance problems

Refrain from tampering with safety, internet, pool, HVAC, security, or other property systems

Smoking and vaping are prohibited inside all properties unless a listing expressly states otherwise.

Illegal activity, dangerous conduct, material misrepresentation, unauthorized events, or serious rule violations may result in termination of occupancy without a refund, subject to applicable law.

13. Pets and Assistance Animals

Pets are permitted only when the specific property allows them and AJ Home Rentals has approved them in advance.

Applicable pet charges, restrictions, breed or size limitations, and rules will be disclosed in the property listing, house rules, or rental agreement.

Bringing an unauthorized pet may result in additional cleaning, damage, or administrative charges and termination of occupancy where permitted.

Requests involving service animals or other legally protected assistance animals will be handled in accordance with applicable law. Guests should contact AJ Home Rentals before arrival so reasonable arrangements can be made.

14. Property Condition and Amenities

Rental properties are individually owned, furnished, and decorated.

Photographs and descriptions are intended to provide a reasonable representation of each property. Furnishings, décor, landscaping, appliances, and minor features may change without notice.

Amenities may occasionally be unavailable because of:

Maintenance or repairs

Community or homeowners’ association decisions

Weather conditions

Utility or internet interruptions

Vendor availability

Circumstances beyond the reasonable control of AJ Home Rentals

Guests must report material concerns promptly and provide AJ Home Rentals a reasonable opportunity to inspect and address them.

Guests may not authorize repairs or incur expenses for reimbursement without advance written approval from AJ Home Rentals, except when reasonably necessary to address an immediate threat to life or property.

15. Pools, Spas, Golf Carts, Recreational Equipment, and Amenities

Use of pools, spas, golf carts, bicycles, grills, recreational equipment, community amenities, and similar features involves inherent risks.

Guests must follow:

Posted safety instructions

Age restrictions

Licensing requirements

Community requirements

Manufacturer instructions

Applicable supplemental agreements

All federal, state, and local laws

Children must be appropriately supervised around pools, spas, golf carts, roadways, and recreational equipment.

Golf carts, when available, may be provided by a property owner or an independent rental provider. Golf-cart use may require a separate agreement, deposit, insurance confirmation, age requirement, driver’s-license requirement, or fee.

AJ Home Rentals does not guarantee access to every community amenity. Guest passes, resident identification cards, amenity privileges, and associated charges are subject to community rules, availability, and approval.

16. Right of Access

AJ Home Rentals, the property owner, and authorized vendors may enter the property when reasonably necessary to:

Address an emergency

Protect persons or property

Perform requested or necessary repairs

Investigate a reported problem or suspected rule violation

Provide agreed services

Conduct inspections

Comply with legal obligations

Show the property when permitted by the applicable agreement and law

Except in emergencies or when otherwise permitted by the rental agreement or applicable law, reasonable notice will be provided.

17. Lost, Forgotten, or Abandoned Property

AJ Home Rentals is not responsible for personal property left behind, lost, stolen, or damaged during a stay.

If an item is located, AJ Home Rentals may arrange return shipping at the guest’s expense, including shipping, packaging, handling, and administrative costs.

AJ Home Rentals does not guarantee that a lost item will be located or returned.

18. Maintenance and Emergencies

Guests should report maintenance concerns promptly using the contact information or reporting method provided with the reservation.

For an immediate threat to life, safety, or property, call 911 or the appropriate emergency service before contacting AJ Home Rentals.

AJ Home Rentals will make commercially reasonable efforts to address reported problems but cannot guarantee uninterrupted:

Electricity

Water

Internet

Cable or streaming services

Appliances

HVAC systems

Pools or spas

Community amenities

Third-party services

Guests must not attempt repairs that may create a safety risk or cause further damage.

19. Events Beyond Reasonable Control

AJ Home Rentals is not responsible for a delay, interruption, relocation, or inability to perform caused by events beyond its reasonable control, including:

Severe weather

Hurricanes, tropical storms, flooding, or natural disasters

Fire or unexpected property damage

Government action

Utility or internet failure

Public-health emergencies

Labor disruptions

Community restrictions

Road closures

Acts or omissions of third-party providers

Other events that could not reasonably have been prevented

When such an event materially affects a reservation, AJ Home Rentals may offer a reasonable alternative property, reschedule the stay, provide a credit, or issue any refund required by the reservation agreement, house and listing rules, or applicable law.

20. Guest Responsibility and Indemnification

To the extent permitted by law, the guest is responsible for claims, losses, fines, damages, and reasonable costs resulting from:

The guest’s breach of these Terms or the rental agreement

Damage caused by the guest, occupants, visitors, or invitees

Unlawful, reckless, or negligent conduct

Violation of community or homeowners’ association rules

Misuse of the property, equipment, or amenities

Unauthorized occupants, visitors, pets, parties, or events

This provision does not require a guest to indemnify AJ Home Rentals or a property owner for that party’s own gross negligence, willful misconduct, or liability that cannot lawfully be limited.

21. Limitation of Liability

To the fullest extent permitted by law, AJ Home Rentals is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the website, a reservation, or occupancy of a property.

AJ Home Rentals is not responsible for the loss, theft, or damage of a guest’s personal belongings, vehicles, or other property unless caused by liability that cannot lawfully be excluded.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

Guests are responsible for securing their personal belongings and obtaining appropriate travel, health, vehicle, and personal-property insurance.

22. Website Use

Website content is provided for informational and booking purposes.

Users may not:

Use the website unlawfully or fraudulently

Interfere with its security or operation

Attempt unauthorized access

Scrape, copy, or commercially exploit website content without permission

Submit malicious code

Impersonate another person

Provide false or misleading information

Make false, fraudulent, or speculative reservations

Use the website in a manner that infringes the rights of AJ Home Rentals, property owners, guests, or third parties

Property photographs, descriptions, logos, text, graphics, and other website materials are owned by AJ Home Rentals, property owners, licensors, or service providers and may not be copied or reused without authorization.

23. Website Accuracy

AJ Home Rentals makes reasonable efforts to provide accurate property, availability, rate, and amenity information.

However, typographical errors, technical errors, synchronization delays, or incorrect availability may occasionally occur.

AJ Home Rentals reserves the right to correct an error before confirming a reservation. If a material pricing or availability error is discovered after confirmation, AJ Home Rentals will notify the guest and offer available options consistent with applicable law.

24. Third-Party Services

Our websites may use or link to third-party booking, payment, mapping, insurance, communication, analytics, or other services.

Third-party services are governed by their own terms and privacy policies.

AJ Home Rentals is not responsible for an independent third party’s acts, omissions, availability, security, or content except to the extent required by law.

25. Electronic Communications and Signatures

Guests consent to receive reservation records, agreements, notices, disclosures, and other communications electronically.

Selecting an acceptance box, submitting a reservation, making a payment, or applying an electronic signature may constitute the guest’s agreement and signature to the extent permitted by law.

Guests are responsible for:

Providing accurate contact information

Keeping their contact information current

Monitoring the email address and telephone number provided

Retaining copies of agreements and reservation records

Electronic records should be downloaded or printed for the guest’s records.

26. SMS Communications

If a guest affirmatively opts in to receive text messages, AJ Home Rentals may send reservation communications, access information, service notifications, account-related messages, and other communications consistent with that consent.

Message frequency varies. Message and data rates may apply.

Consent to receive marketing text messages is not a condition of making a purchase or reservation.

Reply STOP to unsubscribe from the applicable text-message program. Reply HELP for assistance.

27. Privacy

The collection, use, retention, and disclosure of personal information are described in the AJ Home Rentals Privacy Policy.

By using our websites or services, guests acknowledge the privacy practices described in that policy.

28. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Unless a separate signed agreement provides otherwise, any legal proceeding arising from these Terms or a reservation must be brought in a court of competent jurisdiction located in [INSERT COUNTY], Florida, subject to applicable law.

29. Changes to These Terms

AJ Home Rentals may revise these Terms periodically.

Updated Terms will be posted with a new “Last updated” date.

The Terms in effect when a reservation is confirmed will generally govern that reservation unless:

The parties subsequently agree to a modification;

A change is required by law; or

A reservation-specific agreement states otherwise.

30. Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the greatest extent legally permitted.

The remaining provisions will continue in full force and effect.

31. No Waiver

A failure or delay by AJ Home Rentals in enforcing a provision of these Terms does not waive the right to enforce that provision or any other provision later.

A waiver is effective only when confirmed in writing by an authorized representative of AJ Home Rentals.

32. Assignment

Guests may not transfer or assign a reservation or their rights under these Terms without advance written approval from AJ Home Rentals.

AJ Home Rentals may assign its rights and obligations to a successor, affiliated company, property owner, or authorized service provider when permitted by law and consistent with the applicable reservation agreement.

33. Entire Agreement

These Terms, the reservation confirmation, the applicable property listing, house rules, rental agreement, and incorporated addenda constitute the agreement governing the reservation.

These materials supersede prior discussions, representations, or communications concerning the same subject, except for written modifications accepted by the parties.
